For those of you that have followed this thread, this was raised as a concern years ago (the Fed exchanges were not formally authorized in the law for subsidies, thus the providing no basis for enforcing the mandate for such areas that only have Fed Exchanges). Many in the news have said today it was "obviously" the intent of Congress to support the Fed Exchanges. I would remind them that while the bill was still on Congress, Madam Pelosi said "we'll have to pass it to find out whats in it" which tells me they dont know what the intent was (as they rammed the legislation thru in the dark of night via several legislative tricks including reconciliation and didnt necessarily know what was in it (if you recall several Congressmen that voted for it claimed they either didnt read it or claimed they were unfamiliar with many of its provisions.......

I dont agree with the title or thesis of this article, but it does a good job of explaining what the legal issues are with the Supreme Court agreeing to take up Obamacare again. Im not sure how the author came to some of his conclusions. First of all, the law as written clearly doesnt fund the Fed exchanges. Ive heard Congressmen involved with writing the legislation say it was written this way in order to incentivize the States to set up exchanges. I also remember Leader Pelosi's admonition 'we have to pass it to find out whats in it" so Im not sure how the author concludes that the Act intended to fund the Fed Exchanges all along. [IMO they screwed up as they wrote it in the dark of night secretly and rammed it thru Congress and couldnt go back and fix it because the voters got wind of it in Mass and elected Scott Brown to the Senate which took away the 1 Senate vote they needed to use the Reconciliation trick again on the bill]

BTW- after the election this week, the number of Dem Senators that voted for this abomination that are no longer in the Senate is 28. (Wow thats almost 1/3 of the Senate) No wonder most of them running for office didnt want to associate themselves with the Prez.
